Samsung gets a temporary win against Apple in Germany lawsuit, Galaxy Tab 10.1N is legal

Samsung Galaxy Tab 10.1 and Samsung Galaxy Tab 10.1N tabletsIn a preliminary court assessment in Düsseldorf, Germany the new Samsung Galaxy Tab 10.1N tablet was found not to be in violation of Apple’s intellectual property in Germany.

Samsung recently revealed and launched the Samsung Galaxy Tab 10.1N in Germany where the companies Samsung Galaxy Tab 10.1 isn’t allowed to be sold. Apple succeeded in securing an injunction against the Samsung Galaxy Tab 10.1 in August, the injunction was upheld in September after German courts heard Samsung’s appeal.

When compared to the old Galaxy Tab 10.1 the new Galaxy Tab 10.1N featured a visibly different exterior. The speakers for the Galaxy Tab 10.1N are on either side of the tablet (in landscape mode) and there is a new metal rim design. Samsung did a good job making meaningful changes with their Galaxy Tab 10.1N, but Apple still filed court papers requesting a preliminary court injunction in Germany to stop Samsung from selling the re-designed tablet.

Reporters for Reuters recount that Düsseldorf, German Judge Johanna Brueckner-Hofmann said the following in court, “According to the court’s assessment, the defendant [Samsung] has moved away sufficiently from the legally protected design [Apple's design patent which one the initial injunction against the Galaxy Tab 10.1]“.

I think that Apple might want Samsung to design a tablet that’s got a radically different design from their iPad. A radical design that could include a triangular shape for the device, non-Black colored bezel (maybe Orange would suffice?).

All of these court cases that involve intellectual property have many twists and turns, all we can do is sit in the gallery and wait for what will happens next.
